Federal Law allows persons over the age of 65 years to use a pooled special needs trust, but not a private special needs trust. Although there may be a penalty period imposed by Indiana’s FSSA on those using a pooled trust after the age of 65, Indiana’s Medicaid program does allow for aging Hoosiers to use such a trust.
The National Foundation for Special Needs Integrity offers its pooled trust services to all Hoosiers, regardless of age.
