About The President
Shane Service was raised in Franklin, Indiana — a small town of about 18,000 residents situated 20 minutes south of Indianapolis on I-65. Mr. Service attended Franklin College in 1991, graduating as a Ben Franklin Distinguished Scholar in 1996 with degrees in Philosophy and Religion. After graduation, Mr. Service began work at Johnson County Arc, a chapter of The Arc of Indiana. He worked there as a Job Coach and Community Liaison for persons with developmental and traumatic disabilities. Mr. Service spent most of his time helping his clients obtain and maintain gainful employment in the community, coaching them one-on-one where they worked, and acting as a conduit between the employer and the individual. Additionally, Mr. Service assisted his clients in developing daily living skills, such as money management, Special Needs Trust usage, community involvement, and social integration.

Greetings from The National Foundation for Special Needs Integrity! We are committed to serving the needs of parties to mass tort settlements who receive governmental assistance benefits, like Medicaid and SSI.
The attorneys and settlement firm that have teamed up to secure your settlement have referred you to us because you are a recipient of at least one "means-tested benefit," such as Medicaid, Supplemental Security Income (SSI), Food Stamps, HUD/Section 8 Housing Assistance, or other governmental assistance programs. As you know, these governmental agencies limit how much money you can make or how much money you can have at any given time.
So now that you are about to receive your settlement, you are between a rock and a hard place, so to speak. You have the choice of hastily spending this money away on things that you may not need — simply to fall back under the minimum resource limit set by your state and federal governments — or lose your benefits until you have spent your money down to the allowable limit. This choice is sometimes referred to as the dreaded "Spend Down."
Fortunately, the federal government passed a "safe harbor" law in 1993 that allows persons in your situation to place their money in a Special Needs Trust and protect it from being counted against them by Medicaid and other benefits agencies. You will often hear this law referred to as "OBRA '93," which is short for the "Omnibus Budget Reconciliation Act of 1993." You can spend your money at your pace on things you really need while still retaining the priceless governmental assistance that you receive. In 1999, Congress acted again by passing the Foster Care Independence Act of 1999, which allows persons to safeguard their money in the same type of Special Needs Trust and still receive their SSI benefits.
