Despite what you may have heard, a Special Needs Trust can be a lot more flexible than you think.
Oftentimes we at Special Needs Integrity are asked to provide a list of items that a special needs trust can pay for. Unfortunately, the federal and state regulations that govern how a Special Needs Trust can be used are so complex that it is really impossible to draft an all-inclusive list of what goods and services you can and cannot purchase with a special needs trust.
We are providing the following list simply to give you an idea how you may be able to use your trust. This list is not exhaustive. We oftentimes pay for goods and services that do not appear on this list. By the same token, just because an item appears on the list does not mean that it will always be allowable or will be allowable for you. Different states have different regulations. Some states are lenient on Special Needs Trust usage, and some states are severely strict. Special Needs Integrity monitors the national trends regarding Special Needs Trust usage, as well as the specific idiosyncrasies of each state. What may be in one Beneficiary’s interest may not be in the best interest of another. Nevertheless, we can still provide you with a list of disbursements that are routinely made from a Special Needs Trust. Here is a sampling of types of goods and services that Special Needs Trusts routinely pay for:

In some circumstances, we may also be able to help individuals fulfill their parental obligations to their minor children, paying for school fees, clothing, child support, etc. Again, what we can and cannot pay for is dictated exclusively by federal regulations and the regulations in your specific state.
